In South Africa, self-defense is recognized as a legal justification for using force, even deadly force, to protect oneself or others from an unlawful attack that is imminent or in progress. However, the use of force must be proportionate to the threat, necessary, and directed at the attacker. There is no duty to retreat in South Africa before using force in self-defense. 

Key aspects of self-defense in South Africa:

  • Imminent Threat:

    The attack must be happening now or about to happen. Self-defense is not justifiable if the threat has already passed. 

  • Proportionality:

    The force used must be reasonably proportionate to the threat. Using excessive force, such as a firearm against an unarmed assailant, could be deemed unlawful.
